TERMS AND CONDITIONS
These Terms & Conditions apply to all bookings, services, and features offered by The Apanage Gallery within the context of “Apanage Days August 25.”
We’ve kept things as clear, fair, and respectful as possible – so that you know exactly what to expect when you participate.
If you have questions or something feels unclear, you’re always welcome to reach out.
Below you’ll find all relevant terms. They apply once you complete your booking.

These Terms & Conditions apply to all services and offers provided by The Apanage
Gallery, represented by William Lindhorst (sole proprietor), as part of the project
“Apanage Days August ‘25”.
By completing your booking, you agree to these Terms & Conditions. They apply exclusively to this project – just like each exhibition deserves its own frame. -
By booking a slot for “Apanage Days August ‘25,” you secure digital visibility for your
artwork on our curated LED screen in Berlin.
The type and scope of your booked services (e.g. one-time display, rotation, social media
features, content support, or a print feature in the Apanage Magazine may be booked
separately) are outlined during the booking process and detailed in our FAQ.
While we cannot guarantee a specific number of rotations, we ensure your work will be
visibly and respectfully presented during the official exhibition schedule.

Bookings can be made through official Apanage channels. This may include our website,
social media platforms, or direct communication.
Payment is handled in advance via third-party providers such as Stripe or PayPal, or by
invoice if agreed individually. Your participation becomes valid only after the full amount has been received. Until then, your slot remains unconfirmed.
Once payment is complete, you will be invited to register and submit your artwork. Please
note: missing this step or missing the deadline may result in exclusion from the project –
without refund. All payments are processed via certified third-party providers. No payment data is stored by Apanage.

What artists are expected to deliver after booking – by when – and what
happens if they don’t.
Once your payment is confirmed, you’ll receive a link to create your artist profile and submit
all necessary information and files.
Please make sure to submit everything in the correct format and before the communicated
deadline.
As we manage a curated schedule, we’re unable to send individual reminders. If we don’t
receive your material in time or in the required format, we may not be able to include your
work in the exhibition – and no refund can be issued in that case.

Artists keep their rights. Apanage gets permission to showcase and promote
within the project context.
By submitting your work, you grant Apanage the right to showcase and share it in connection
with the exhibition – before, during, and after the official project period.
This includes presentation on our website, social media channels, and promotional materials
related to the project.
The usage is non-exclusive, non-commercial, and strictly tied to the context of Apanage
Days August ‘25.
Any use beyond this scope requires your written approval. We may reach out to selected
artists for extended usage opportunities beyond the project – always with your clear consent.

If you book a feature in the Apanage Magazine, you agree to have your artwork and artist name published in print, alongside a short statement or editorial context.
The rights to your work remain with you. The print usage is limited to the agreed edition and does not extend to resale or external licensing.

Protection from harmful content, violations of law or ethics. Apanage’s right to
decline entries.
We care deeply about what gets seen. For this reason, Apanage reserves the right to
decline or remove any content that violates laws, promotes violence, hate, or discrimination,
or contradicts the values of the project.
In addition, we are bound by the editorial and technical guidelines of the public screen
provider. This means that all submitted artwork is subject to a final review and approval by
the media owner.
The media owner may reject content at their discretion, especially if it includes political
messaging, explicit sexual material, or extremist language or symbols.
If your work is declined due to these internal or external guidelines, we will – if appropriate –
invite you to submit an alternative version within the given timeframe.
However, in cases of clearly intentional violations (e.g. hate symbols, incitement, fake
copyright ownership), Apanage reserves the right to exclude the artist without further
invitation and without refund.
Please only submit original work that you have the legal rights to share.

What’s refundable, what’s not. How the withdrawal works (and under which
conditions it’s valid). Once your booking is confirmed and payment is complete, refunds are generally not possible – especially if registration has already started or content has been submitted. Exceptions may apply in clearly defined cases (e.g. technical errors or double payments). If your content is declined due to internal or external guidelines, and a resubmission is not possible or not provided, we reserve the right to withhold a refund.
You have the right to withdraw from the agreement within 14 days of booking – as long as no
registration or content upload has taken place. To do so, please submit our official withdrawal form by withdrawal@apanage.gallery. Refunds will be issued minus any non-refundable third-party transaction fees, if applicable.

If your submission is declined due to internal or external guidelines, we may
invite you to revise and resubmit your work within the given timeframe.
One resubmission is included free of charge if you booked the Creative Support package.
If Creative Support was not booked, a processing fee applies. This covers the
additional time and review effort involved and is designed to encourage
thoughtful submissions from the start.
Further resubmissions are not guaranteed and may be declined based on
timing, quality, or capacity.

We strive to apply taxes in accordance with current national and international regulations.
Rates are determined based on the buyer’s country of residence and the nature of the product or service purchased.
In rare cases, minor discrepancies may occur due to technical limitations or recent legal adjustments.
By completing the checkout, participants accept this possibility and acknowledge our ongoing commitment to compliance and transparency.

What Apanage is not responsible for – from technical issues to external risks
and public display.
Apanage is not liable for disruptions caused by technical issues, external service providers,
or events beyond our control. This includes, but is not limited to: power outages, hardware
failure, screen downtime, or data loss caused by third-party partners (e.g. photographers or
video teams).
We make every effort to ensure a professional, smooth experience – but we cannot
guarantee permanent display, reach, or personal satisfaction.
Apanage also cannot be held responsible for how artworks are perceived, interpreted, or
interacted with in a public setting.

Artists are fully responsible for the legal validity of all submitted content.
This includes intellectual property rights, third-party permissions, and compliance with jurisdictional laws. Apanage assumes no responsibility for external claims resulting from violations of such rights. In case of reported or suspected infringement, we reserve the right to remove or withhold content at any time.

Personal and content-related data is collected solely for the purpose of project execution and communication. We rely on external providers (e.g. Stripe, PayPal, cloud services) to securely process transactions and manage participation.
By completing your purchase, you consent to their involvement.
Submitted content will be deleted after the completion of the exhibition, unless legal or technical reasons require otherwise.

In the event of unexpected circumstances – such as technical failure, power outages, regulatory interventions, or public disruption – Apanage reserves the right to postpone, adapt, or cancel scheduled features.
Where possible, an alternative solution will be offered. Refunds or compensation are excluded in such cases unless proven to result from gross negligence on our part.

Some services depend on third-party platforms and infrastructures beyond our direct control. This includes, but is not limited to, payment processors, hosting environments, digital signage providers, and data storage services.
While we select partners with care and diligence, Apanage cannot be held liable for performance, policy changes, or failures occurring within these external systems.

Jurisdiction, applicable law, and how changes to these terms are handled.
These Terms & Conditions are governed by German law. Place of jurisdiction is Berlin,
unless otherwise required by law.
If any provision of these Terms is found to be invalid or unenforceable, all remaining parts
shall remain unaffected.
We may update these Terms & Conditions to reflect changes in law, taxation, technical systems, or project operations.
Such updates do not apply retroactively and do not affect bookings already completed.
The version of the Terms accepted at the time of purchase remains valid for that transaction.
Future bookings will be subject to the updated version, which will be made available on our website. -
We cooperate with legal and regulatory authorities where required. If your data or submissions are subject to official inquiry, we may disclose relevant information in accordance with applicable laws. Participants will be informed if such cooperation directly affects their rights, unless disclosure is prohibited by law.

These Terms are here to create clarity, not distance. To hold space, not control it.
