These Terms & Conditions apply to all participation agreements with The Apanage Gallery, represented by William Lindhorst (sole proprietor), in the context of temporary exhibition projects under the name “Apanage Days”.

By paying the participation fee for a specific edition, you accept these Terms & Conditions as the legal basis for your participation.

The applicable project details (e.g. location, timing, deadlines) are communicated separately as part of the respective call for participation.

By completing your booking and paying the participation fee, you confirm your participation in the corresponding edition of Apanage Days.

The exhibition includes the presentation of selected works on a public LED screen in Berlin. The selection, timing, and format of the display are determined by Apanage based on curatorial and technical criteria.

There is no automatic entitlement to specific screen time, visibility, or additional services beyond project inclusion. Participation does not include any guaranteed media coverage, promotional features, or print publication unless explicitly stated.

Participation in Apanage Days requires payment of a participation fee.

Confirmation of participation follows an official invitation or approval by the Apanage team.

The fee must be paid in advance via certified third-party providers such as Stripe or PayPal, or by invoice if individually agreed.

Participation becomes valid only after the full amount has been received. Until then, no slot is guaranteed.

After successful payment, participants will receive further instructions regarding registration and file submission.

Please note: if these steps are not completed by the communicated deadline, participation may be cancelled without refund.

After payment, participants will be asked to submit their materials through a dedicated form.

All required files must be provided in the correct format and by the communicated deadline.

Late or incomplete submissions may lead to exclusion from the project without refund.

Apanage is not responsible for sending individual reminders.

By submitting your artwork, you grant Apanage a non-exclusive, project-related right to use the material for the purpose of promoting and documenting the current and future editions of Apanage Days.

This includes the right to present the artwork on public screens, websites, social media channels, press materials, newsletters, and other non-commercial platforms operated by Apanage Gallery.

You retain all rights to your work.

No resale, merchandising, or third-party licensing will take place without your written permission.

Apanage reserves the right to reject or remove submissions that violate laws or contradict the values of the project.

This includes content that is discriminatory, violent, defamatory, or otherwise inappropriate for public display.

All submissions are subject to editorial and technical review by Apanage and external providers.

In case of a violation, participation may be revoked without refund.

Once participation is confirmed and payment is complete, refunds are generally not possible.

This also applies if materials are not submitted or deadlines are missed.

You have the right to withdraw from the agreement within 14 days of payment, provided no content has been submitted.

To do so, please contact us in writing. Refunds will be issued minus any non-refundable transaction fees, if applicable.

Apanage is not liable for disruptions caused by technical issues, external service providers, or events beyond our control.

This includes, but is not limited to: hardware failure, power outages, screen downtime, or data loss.

We are not responsible for how submitted works are perceived or interpreted in public space.

Participants are solely responsible for the legal rights to all submitted content.

These Terms & Conditions are governed by German law.

Place of jurisdiction is Berlin, unless otherwise required by law.

If individual clauses prove to be invalid, the remaining provisions remain unaffected.

We may update these Terms & Conditions in the future. The version accepted at the time of booking applies to your participation.

These Terms are intended to provide clarity and fairness for all participants.

We appreciate your contribution and your commitment to participating respectfully in this project.
